Thank you for the opportunity to be of service to you by performing an accessibility evaluation for the Pike Park located at 2610 N Chestnut St, West Colorado Springs, CO 80907. The facility was inspected on 08/16/2021.
The site evaluation includes the primary path of travel from the public way, parking lot area, the restrooms and all interior public areas within the Pike Park. This evaluation excludes all employee work areas. This on site evaluation proceeds a proposed remodel of the facility which will include barrier removal in the areas evaluated. This is a facility evaluation and not a CASp inspection as defined in Civil Code Section 55.51 or a substitution for a comprehensive self-evaluation and transition plan as required for all Title II facilities. This evaluation is be based on the 2010 ADAS and current California Building Code.
Title II public entities were required to achieve program accessibility by January 26, 1992. If structural changes were needed to achieve program accessibility, they must be made as expeditiously as possible, but in no event later than January 26, 1995. This three-year time period is not a grace period; all changes must be accomplished as expeditiously as possible. Unlike private entities under Title III, public entities are not required to remove barriers from each facility, even if removal is readily achievable. A public entity must make its "programs" accessible. Physical changes to a building are required only when there is no other feasible way to make the program accessible. Accessible telephones and bathrooms should also be provided where these services are available for use by the public.
Renovation or new construction that occurred after January 26, 1992, are subject to meet full code specifications of the Americans with Disabilities Act (ADA) Code of Federal Regulations (CFR) and Title 24 part 2 of the California Building Code (CBC). In addition to full compliance with the Americans with Disabilities Act (ADA) and the CBC for the specific areas of remodel, Public Entities have an obligation to ensure that the path of travel (includes parking lot and path of travel from the public way) to the areas of new construction or remodel are in compliance with the most restrictive provisions of either the ADA or the CBC.

The surface of the pedestrian access route has vertical discontinuities greater than 1/2 inch or between 1/4 inch and 1/2 inch that are not beveled.
Vertical surface discontinuities shall be 13 mm (0.5 in) maximum. Vertical surface discontinuities between 6.4 mm (0.25 in) and 13 mm (0.5 in) shall be beveled with a slope not steeper than 50 percent. The bevel shall be applied across the entire vertical surface discontinuity.Advisory R302.7.2 Vertical Surface Discontinuities. The allowance for vertical surface discontinuities is for occasional expansion joints and objects such as utility covers, vault frames, and gratings that cannot be located in another portion of the sidewalk outside the pedestrian access route. However, objects such as utility covers, vault frames, and gratings should not be located on curb ramp runs, blended transitions, turning spaces, or gutter areas within the pedestrian access route. This may not always be possible in alterations, but should be avoided wherever possible. Vertical surface discontinuities between unit pavers should be minimized.

Restroom

If sanitary facilities are provided, they must be made accessible to persons with disabilities. If public restrooms are desired, It is recommended that the portable unit be replaced with a permanent built in compliant restroom. The utilization of an accessible portable unit may be a temporary solution and is not recommended as a permanent solution.
Each toilet room and bathing room shall be accessible. Where a floor level is not required to be connected by an accessible route, the only toilet rooms or bathing rooms provided within the facility shall not be located on the inaccessible floor. Except as provided for in Sections 1109.2.2 and 1109.2.3, at least one of each type of fixture, element, control or dispenser in each accessible toilet room and bathing room shall be accessible.
2010 ADAS Section 213.1
Where toilet facilities and bathing facilities are provided, they shall comply with 213. Where toilet facilities and bathing facilities are provided in facilities permitted by 206.2.3 Exceptions 1 and 2 not to connect stories by an accessible route, toilet facilities and bathing facilities shall be provided on a story connected by an accessible route to an accessible entrance.
